WHAT IS PERSONAL DATA AND WHAT PERSONAL DATA DOES ICEA LION GROUP COLLECT AND PROCESS ABOUT YOU?

What is Personal Data? For the purposes of this Privacy Notice “Personal Data “ consists of any information that relates to you and/or information from which you can be identified, directly or indirectly. Personal data includes information such as your name, telephone number, address, national identity card number etc. What Personal Data does ICEA LION Group Collect and Process? We may collect, process, store and transfer different kinds of personal data about our customers, employees, service providers, agents and other stakeholders. The table below summarizes the type of personal data including sensitive personal data that we collect and process.

Provision of Personal Data In offering our products and services and pursuant to legal and regulatory requirements and obligations, our customers are obliged to provide personal data to us. The personal data provided enables us verify customer data so that our customers can purchase or be availed with their chosen financial products or services. Failure to provide us with the personal data may mean we cannot fulfil our obligations of the contract for provision of products and services and you would not have access to the said products or services.

 

HOW IS YOUR PERSONAL DATA COLLECTED?

ICEA LION Group endeavors to obtain personal data directly from you. However, this is not an absolute mechanism in obtaining such personal data and we may obtain personal data from other third parties such as government agencies, public databases etc. We also may obtain personal data through the use of technology such as cookies when you use our website and our other digital platforms. In circumstances where personal data is obtained from third parties, we shall obtain such information in full compliance with the provisions of the Data Protection Act and Regulations. We obtain personal data about you from sources such as; Application forms, proposal forms, claim forms and other forms that you fill. Software applications (apps) made available by us to you. Our website (www. icealion.co.ke). Meetings, telephone conversations and other forms of communication. Social media applications and/or tools. Our service providers such as brokers, agents, assessors and medical practitioners.

HOW DO WE USE YOUR PERSONAL DATA?

We may use the personal data we collect for the following purposes: Know Your Client (KYC) and Customer Due Diligence (CDD). Communicating with customers, business partners and employees. Assessing and making determinations on provision of financial products or services, employing persons as employees and such other business decisions. Enhancing and improving product and service offering including maintaining information security. Fulfilling regulatory requirements such as filing reports with various Regulators such as Insurance Regulatory Authority (IRA), Financial Reporting Centre (FRC), Capital Markets Authority (CMA), Retirements Benefits Authority (RBA),etc. Carrying out research and data analysis including actuarial analysis, customer satisfaction surveys and assessment of business risks in accordance with applicable law. Providing marketing information through communication channels such as email, text messages and other platforms. Personalizing user experience in the digital tools such as website and the self-service portal. To respond to feedback, queries and complaints that you submit through our feedback form. Facilitating business operations including information technology systems. Enforcing and defending legal right accruing due to the nature of business operations. The Data Protection Act and Regulations law allows us to use the personal data we collect as set out above on the basis that the processing is necessary for the performance of a contract with you, or we are acting in our legitimate interests e.g. in the provision of the insurance, investment or trust products and services. We may process your personal data to send you marketing communications by email , SMS text message, telephone call or any other appropriate means of communication . The legal justification for this direct marketing could that you have consented to the same or it is in our legitimate interest to avail to information that is relevant to the products or service you have or propose to obtain from us. However, our use of your personal data in this nature and context is subject your rights as provided for in the Data Protection Act exercised through the various tools and procedures we are mandated to make available to you.

WHAT IS THE LEGAL JUSTIFICATION FOR OUR USE OF PERSONAL DATA?

We process personal data: To comply with applicable legal requirements e.g. a requirement to avail information to one of our regulators such as Financial Reporting Centre on Anti-Money Laundering, Insurance Regulatory Authority on insurance matters etc. To fulfil terms of a contract or in preparation of entering into a contract with you. This occurs primarily in the offering of our insurance, investment, pension and trusts financial products e.g. when completing a proposal form to take up an insurance policy where you provide us with your personal data in the fulfilment of that insurance contract. In the absence of being availed personal data, we may not provide the financial products and services. As a result of a consent provided by you to us e.g. where you consent to receiving information pertaining to a financial product or service from us via email or text message. For public interest such as when complying with obligations set out by Proceeds of Crime and Anti-Money Laundering Act in relation to disclosure of your personal data. For our legitimate interest such as undertaking actuarial analysis to enhance our insurance products. We commit to always identify and document the lawful basis of processing your personal data for each specific purpose and put the necessary safeguards to ensure that the lawful basis is always applicable. Further we shall endeavor to provide you the highest degree of autonomy with respect to control over your personal data and provide simplified processes of consenting or withdrawing consent to the processing of your personal data.

TO WHOM DO WE DISCLOSE YOUR INFORMATION?

We will only use your personal data for our internal business purposes as described above. We may disclose your data to any third party subject to your request or consent or in furtherance of our legitimate interests. The table below provides some examples of whom we may share your personal data.

Business Partners Where legally permitted including to establish, exercise or defend our legal rights, we may share personal data with third party service providers such as auditors, lawyers, actuaries, accountants, medical service providers, banks, assessors, loss adjustors, re-insurers insurance brokers and agents, Independent Financial Advisers, other insurance companies,stock brokers, fund managers, other business partners and other third party vendors and outsourced service providers that assist in carrying out business activities.
Industry Associations Where legally permitted personal data may be shared with industry associations such as Association of Kenya Insurers, Fund Managers Association, Kenya Association of Stock Brokers and Investment Bankers, Scheme Administrators, Custodians, REITs Association of Kenya etc.

We shall in all circumstances where feasible and legally justifiable, inform and seek consent from you prior to sharing your personal data. We shall however provide your personal data whenever we are legally obligated to provide such information.

WHAT DO WE DO TO KEEP YOUR INFORMATION SECURE?

We have put in place appropriate physical, legal technical and organizational measures to safeguard the personal data we collect in connection with our services. Such measures include; requiring confidentiality from employees and other person (s) who handle personal data, information technology security measures such as system rights and firewalls. We process and store most of your personal data electronically and have put measures to ensure the security of your personal data as described above. Information Communication and Technology (ICT) systems remain vulnerable to new and unforeseen risks however we have and shall continue to deploy appropriate technical and organizational mechanisms to secure your personal data.

INTERNATIONAL TRANSFER OF YOUR PERSONAL DATA

Prior to transferring personal data outside Kenya, we shall ascertain that the transfer is based on the provided legal and regulatory standards. Circumstances in which we may transfer your personal data outside are highlighted in the table below;

DATA RETENTION – HOW LONG WE WILL STORE/KEEP YOUR PERSONAL DATA

We retain personal data for as long as necessary to fulfil the purposes for which your personal data has been collected as outlined in this Privacy Notice unless a longer retention period is required by law. Generally, the law requires us to retain your personal data for a period of 7 years at which point the information shall be removed from our information technology infrastructure or physical storage space and either deleted/ destroyed or archived. Your personal details for marketing communications will be retained for a period of three years from the date of your last interaction with the marketing communication (i.e. opening an email or clicking on a link within the email) at which point all of your personal details is removed from our systems.

ACCESSING YOUR PERSONAL DATA AND OTHER RIGHTS YOU HAVE

We will collect, process and store your personal data in accordance with your rights under the Data Protection Act and attendant Regulations. Under certain circumstances, you have the following rights in relation to your personal data:

Description of Right When is the right applicable?
Right to object to processing of personal data– You have a right to object to the processing of their personal data. In implementation of this right, you shall use the statutory form “Request for restriction or objection to the processing of personal data” provided in our website. The right is not an absolute right and we can reject the request where we demonstrate that we have justifiable reasons for processing that would negate your interests e.g. when we are required by a government agency exercising their legal mandate to provide your personal data against your request not to avail the same or in our defence of a legal claim. We will always inform you when we have decline your request and provide the reasonsThis right is however absolute when it relates to direct marketing.
Right to restrict processing of personal data– You have the right to request the suspension of processing of your personal data in certain circumstances. In implementation of this right, you shall use the statutory form “Request for restriction or objection to the processing of personal data” provided in our website This right is not an absolute right and shall be available when;(a)You contest the accuracy of your personal data;(b) Your personal data has been unlawfully processed and you oppose the erasure and request restriction instead;(c) You no longer need your personal data but we require the same to be kept in order to establish, exercise or defend a legal claim;(d) You have objected to the processing, pending verification as to whether our use of your personal data is justifiable and overrides your interests.
Right to access personal data- You have the right to access your personal data and obtain information of how the said personal data is used and processed. In implementation of this right, you shall use the statutory form “Request for access to personal data” provided in our website. You may access your personal data through our Self-Service Portal (https://selfservice.icealion.com/login) Should you want to access your personal data in any other format, you may use the form subject to availing us available notice and other circumstances as shall be communicated by us to you.
Right to rectification of personal data-, You have the right to request your personal data to be corrected in instances of inaccuracy or incompleteness. In implementation of this right, you shall use the statutory form “Request for rectification” provided in our website. The right is available always subject to the discretion accorded to us to decline with reasons.
Right to data portability-You have the right to receive your personal data in a structured, commonly used and machine-readable format to transmit the said personal data obtained to another third party without any hindrance. In implementation of this right, you shall use the statutory form “ Request for Data Portability” provided in our website This right is available always provided that it is technically feasible for us to provide the personal data in the required format.
Right to erasure– This right is sometimes referred to as “the right to be forgotten” and entitles you to request deletion or removal of your personal data from our records. In implementation of this right, you shall use the statutory form “Request for erasure of personal data “provided in our website. Right of erasure does not apply if processing of your personal data is necessary for one of the following reasons—(a) To exercise the right of freedom of expression and information;(b) To comply with a legal obligation e.g. our requirement to hold on to your personal data in the event of an ongoing investigation;(c) For the performance of a task carried out in the public interest or in the exercise of official authority;(d) For archiving purposes in the public interest, scientific research, historical research or statistical purposes where erasure is likely to render impossible or seriously impair the achievement of that processing; or(e) For the establishment, exercise or defence of a legal claim.
Right to complain to the Office of the Data Commissioner. This right is available always.
Right to withdraw consent to processing of personal data. This right only applies where personal data is processed based upon your consent.
Rights relating to automated decision making and profiling- You have a right not to be subjected to a decision based solely on our automated processing, including profiling, which legally and significantly affects you This right is not applicable when a decision is:(a) Necessary for entering into, or performing, a contract between you and us.(b) Authorised by a law to which we are subject and which lays down suitable measures to safeguard your rights, freedoms and legitimate interests; or(c) Based on your consent.

ENFORCING YOUR RIGHTS

If you wish to enforce any of your rights as highlighted above as provided under the Data Protection Act and attendant Regulations, then please contact us on our details in clause 15 below. You may use the various statutory forms made available by us and we will respond to your request without undue delay and within the statutory timelines.

COMPLAINTS

If you feel we have not complied with your right to privacy and other provided rights regarding your personal data, you have a right to complain to us through the provided tool available on our website or you may pay us a visit and fill the complaint form and we shall endeavor to resolve such a complain. You however have the right to contact the Office of the Data Commissioner or such other data supervisory authority in the jurisdiction we operate in.

These Online Platform Use Terms and Conditions (“Terms”) govern your access to and use of either ICEA LION Life Assurance Company Limited, ICEA LION General Insurance Company Limited, ICEA LION Asset Management Company Limited or ICEA LION Trust Company Limited together referred to as “ICEA LION Group” and each independently referred to as “ICEA LION” online platform (the “Platform”) provided by ICEA LION Group, located at ICEA LION Centre, Riverside Park, Chiromo Road, Westlands, Nairobi, Kenya (“we,” “us,” or “our”). The Platform is designed to facilitate the onboarding of new customers for any of our products and/or services. 

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines referenced herein. If you do not agree to these Terms, please do not use the Platform. 

Acceptance of Terms

Binding Agreement: These Terms constitute a legally binding agreement between you and ICEA LION.

Eligibility: By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. If you are using the Platform on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms and conditions.

Purpose of the Platform

The Platform is intended to allow prospective customers to:

● Submit applications or proposals for any of our products and services.

● Provide necessary personal and financial information for underwriting or onboarding purposes.

● Review policy terms and conditions.

● Communicate with our representatives regarding their application.

● Access other related services as may be offered from time to time.

User Accounts and Security

Account Creation: To access certain features of the Platform, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for maintaining the confidentiality of your account login credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this Section.

No Sharing: You agree not to share your account credentials with any third party.

User Responsibilities and Conduct

Accurate Information: You are solely responsible for the accuracy, completeness, and truthfulness of all information you provide on the Platform, including but not limited to personal details, financial information, and responses to application questions. Providing false or misleading information may result in the rejection of your application, cancellation of your policy, and/or legal action.

Lawful Use: You agree to use the Platform only for lawful purposes and in accordance with these Terms. You will not use the Platform to:

● Violate any applicable local, national, or international law or regulation.

● Engage in any fraudulent, deceptive, or misleading activity.

● Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

● Transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.

● Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.

● Interfere with or disrupt the Platform or servers or networks connected to the Platform.

● Attempt to gain unauthorized access to any portion of the Platform, other accounts, computer systems, or networks connected to the Platform, whether through hacking, password mining, or any other means.

Respectful Conduct: You agree to engage in respectful and professional conduct when interacting with our representatives through the Platform or any associated communication channels.

Intellectual Property

Ownership: All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of ICEA LION Group or its content suppliers and is protected by intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use in accordance with these Terms.

Restrictions: You may not copy, reproduce, distribute, display, perform, modify, create derivative works from, transmit, or in any way exploit any part of the Platform without our prior written consent.

Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and disclose your personal information. By using the Platform, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.

Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by ICEA LION Group. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that ICEA LION Group shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Disclaimers

“As Is” Basis: The Platform is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

No Guarantee of Coverage: The information provided on the Platform is for general informational purposes only and does not constitute an offer to sell any of our products or services. Your submission of an application through the Platform does not guarantee that you will be approved or eligible for any of our products or services. All applications are subject to our onboarding guidelines, underwriting guidelines and approval process.

Accuracy of Information: While we strive to ensure the accuracy of the information on the Platform, we do not warrant that the information is complete, reliable, current, or error-free.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall ICEA LION Group, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of

or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Indemnification

You agree to indemnify, defend, and hold harmless ICEA LION and its affiliates, officers, directors, employees, consultants, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.

Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be finally settled by arbitration in accordance with the Arbitration Act, 1995 and the rules of the Chartered Institute of Arbitrators, Kenya Chapter. The seat of the arbitration shall be Nairobi, Kenya. The arbitration shall be conducted in the English language.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and ICEA LION regarding your use of the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
